THE HOSTING SERVICES AGREEMENT – www.mysite.lk , www.mymail.lk

All Customers of LK Domain Registry (LKDR)’s web/email-hosting (mysite.lk/mymail.lk) and related services (MyMail, EasyHosting, FastWeb) are subject to the terms and conditions contained in the Hosting Services Agreement, which include the following documents by reference: (part 01) General Terms and Conditions (part 02) Privacy Policy and (part 03) Acceptable Use Policy.

Part (01)
  1. General Terms and Conditions1.1. THE HOSTING SERVICES AGREEMENTAll Customers of LK Domain Registry (LKDR)’s web-hosting (mysite) and related services (MyMail, EasyHosting, FastWeb) are subject to the terms and conditions contained in the Hosting Services Agreement, which include the following documents by reference: (i) General Terms and Conditions (ii) Privacy Policy and (iii) Acceptable Use Policy.1.2 DEFINED TERMSSome words used in the Agreement have particular meanings:“Acceptable Use Policy” or “AUP” means the LKDR Acceptable Use Policy as of the date you sign the Agreement.“Business Day” or “Business Hours” means 8.30 am to 5.00 pm Monday through Friday, excluding mercantile holidays in Sri Lanka.1.3 OBLIGATIONS of LKDRThe LKDR shall be solely and personally responsible for the due performance of all the terms and conditions in this Agreement.1.4 OBLIGATIONS OF THE CUSTOMERYou, the customer, must use reasonable security precautions in connection with your use of the Services. You must comply with the laws applicable to your use of the Services and with the Acceptable Use Policy. Both parties must agree to work together to promptly resolve any disputes.1.5 PROMISES WE DO NOT MAKEWe, LKDR do not promise that the Services will be uninterrupted, error-free, or completely secure. You, the customer acknowledge that there are risks inherent in Internet connectivity that could result in the loss of your privacy, confidential information and property.LKDR disclaims all warranties or conditions not expressly stated in the Agreement to the maximum extent permitted by law, including the implied warranties relating to satisfactory quality and fitness for a particular purpose, with respect to the services. LKDR does not guarantee that users will be able to use the services at times or locations of their choosing. LKDR does not warrant that the services are compatible with any third party service or software, even if such third party claims, represents or warrants that such service or software is compatible with any service or LKDR in particular. Any services that we are not contractually obligated to provide but that we may perform for you at your request and without any additional charge are provided on an ‘”AS IS, AS AVAILABLE” basis without any warranty of any kind.LKDR will provide advice or support services only to your administrative or technical contacts listed on your account and no advice or information given by LK DR directly to your end-users unless specifically agreed.1.6 TAXES ON SERVICES: All government taxes will be applicable.1.7 TERMS AND FEESAll the Terms and Conditions mentioned here will be applicable for any of the mysite.lk services. Pricing of the packages/renewal chargers will be applicable as listed in the website www.mymail.lk or www.mysite.lk. LKDR has the authority to change the package pricing where necessary when upgrading the packages or service level.1.8 SUSPENSION OF SERVICESIn the event of notice of possible violation by Customer of the AUP, LKDR may immediately take corrective action, including removal of all or a portion of the User Content, disconnection or discontinuance of any and all Services, or termination of the Agreement. In the event LKDR takes corrective action due to a violation of the AUP, LKDR shall not refund to Customer any fees paid in advance of such corrective action. Customer hereby agrees that LKDR shall have no liability to Customer or any of Customer’s end-users due to any corrective action that LKDR may take including, without limitation, suspension, termination or disconnection of Services.LKDR will also suspend the service if an attack is launched on your Hosted System or your Hosted System is accessed or manipulated by a third party without your consent.
  2. Warranties2.1 LKDR WARRANTIESLKDR represents and warrants that it has the power and authority to enter into and perform its obligations under the hosting services agreement and the services under this agreement shall be performed in a professional manner, consistent with industry standards.2.2 CUSTOMER WARRANTIESCustomer represents and warrants that: (i) Customer has the power and authority to enter into and perform its obligations under this Agreement; (ii) Customer shall use commercially reasonable efforts to prevent unauthorized access to any restricted areas of the Website and any databases or other sensitive material generated from or in connection with the Website; and (iii) Customer Content does not and shall not contain any content, materials, advertising or services that are inaccurate or that infringe on or violate any applicable law, regulation or right of a third party, including, without limitation, export laws, or any proprietary, contract, moral, or privacy right or any other third party right, and that Customer owns the Customer Content or otherwise has the right to place the Customer Content on the Website. Should Customer receive notice of a claim regarding the Website, Customer shall promptly provide LKDR with written notice of such claim.2.3 DISCLAIMER OF WARRANTY.Except for the limited warranty set forth in section 2.1, LKDR has not, and does not, make any warranties whether express or implied. This disclaimer includes, but is not limited to, the warranties of non-infringement, fitness for a particular purpose, warranties of merchantability and title. LKDR specifically disclaims any and all warranties regarding services provided by third parties, regardless of whether those services appear to be provided by LKDR.
  3. Limitation of Liability LKDR shall not be liable for nonperformance or delay in performance caused by any reason, whether within or outside of its control. In no event shall LKDR be liable under contract, negligence, tort, conversion, copyright infringement, trademark infringement, IP rights holder infringement, strict liability or any other legal or equitable theory for any direct, indirect, incidental, exemplary or consequential damages (including, without limitation, loss of use, lost profits, loss of data or information of any kind or loss of business goodwill or opportunity) whether or not LKDR has been advised of the possibility of such loss or damages. LKDR shall not be liable for the cost of procurement of substitute goods, services or technology. LKDR’s entire liability and customer’s exclusive remedy with respect to any use of the services is the cancellation of customer’s account as set forth herein. In no event shall LKDR’s liability to you, the customer, exceed any amounts actually paid in cash by you, the customer, to LKDR for the prior one month period.

Part (02)

Privacy Policy

This Privacy Policy describes the commitment of LK Domain Registry (LKDR) to the privacy of information collected from its customers. The purpose of this Privacy Policy is to provide Users with an understanding of what types of information we collect, how we treat it, and choices they may have related to this information. We reserve the right to change our Privacy Policy at any time.

  • Who We AreThe LK Domain Registry(LKDR)is the national body which registers internet domain names in Sri Lankan country code top level internet domain (ccTLD) ‘.lk’ as well as the relevant Sinhala and Tamil language top-level domains. In addition, it also providesweb-hosting and related products and services to corporate clients, individuals, non-profit organizations, societies etc.
  • Information Collected
    • Customer Information
      The customers are requested to provide certain personal information when they sign up for LKDR services including name, postal address, email address, telephone number etc.). In addition, to register a domain name, customers are required to provide the information of the registrant, administrative contact, technical contact and billing contact of the domain name (collectively, “Domain Name Registration Information”), for submission to the registration database.
    • Cookies and Tracking
      LKDR keeps different types of cookies (electronic collections of information stored on a local computer to keep track registered users) and other methods of uniquely tracking the registered users for different purposes such as improve our website, customer account management.
    • Customer Surveys
      LKDR may periodically conduct customer surveys in order to improve our services. The information we gather will remain confidential.
    • Log Files
      LKDR maintains general log files for each and every customer and the personal information about customers may be included in the log files.
  • Use of Information
    • Customer Contact/Account Information
      The information collected from customers are used to manage their accounts (such as for billing and account management purposes) and to promote other products or services that LKDR believes may be of interest to its customers.
    • Analytics/Statistics.
      LKDR uses information gathered from its website analytics (for example, User IP addresses) to help diagnose problems with servers, and to administer and optimize services.
    • Responses to Email Inquiries
      When customers send email inquiries to LKDR, the return email address (and other personal information provided in the inquiry) is used to answer the email inquiry received.
    • Customer Surveys
      LKDR may use the contact information provided in customer surveys to follow up on survey answers and may also contact you to highlight the changes LKDR makes in response to your feedback.
  • Sharing of Information
    • Confidentiality
      LKDR will not provide or sell to any third party its customers’ personal information and will keep all customer information confidential.
    • Online Advertisements
      LKDR does not share personally identifiable information about customers with advertisers.
    • Data Security
      Customer information collected through LKDR portal/website is protected by Secure Sockets Layer (SSL) encryption technology during transmission. The information will be stored in our local databases and is protected using industry standard security measures. No means of communication or information transmission or storage is totally secure. Because of this we are not responsible for loss corruption or unauthorized acquisition and use of information covered by this Privacy Policy, or for any resulting damages, including unauthorized acquisition and use.
    • Revisions to this Policy
      LKDR reserves the right to revise, amend, or modify this Privacy Policy at any time and in any manner. We encourage you to periodically review our terms and conditions for the latest information.

Part (03)

Acceptable Use Policy – www.mysite.lk www.mymail.lk www.mycloud.lk

The Acceptable Use Policy (AUP) developed by LK Domain Registry (LK Domain) governs the use of the products and services offered by us, and ensure that the customers understand all the policies and procedures we have developed to comply with certain laws and regulations. All customers must comply with this AUP. Your use and/or continuation of the Service constitute your acceptance of this AUP.

LK Domain reserves the right to refuse to provide the Service at our sole discretion. The version of this AUP, available here, is the most recent version. LK DOMAIN may modify this AUP at any time without notice.

    1. Website/Email Space Use PolicyThe customer may use the hosting space provided to host their website (builder)/email. The customer may host files/use emails within acceptable limits as below.
      • Should not exceed the defined package (with MyMail, EasyHosting, FastWeb) size (for both email/website or any > ex – 10gb for mymail/siteBuilder) – you may need to upgrade if any
      • Should not use email for bulk promotions (sending large amount of emails at once), and should not exceed 100 emails per hour in total (from all accounts) and not more than 1000 emails from the domain (from all accounts) per day.
      • Should not exceed the email attachment size as defined by the webmail client ( ex – 08Mb)
      • Should not use the website (builder) for uploading the defined, under 3.Prohibited Content and Activities (d. Unacceptable Material) & under 4. Unacceptable Resource Usage
    2. Use of the Services
      1. The services may be used for lawful purposes only
        • You may NOT use LK Domain Services or facilities, to engage in, foster, or promote illegal, abusive, or irresponsible behavior, including:
        • Transmission, storage, or presentation of any information, data or material in violation of any applicable law or regulation.
        • Forging, misrepresenting, omitting or deleting message headers, return mailing information, and/or internet protocol addresses, to conceal or misidentify the origin of a message;
        • Creating or sending Internet viruses, worms or Trojan horses, flood or mail bombs, or engaging in denial of service attacks;
        • Hacking, and/or subverting, or assisting others in subverting, the security or integrity of our products or systems;
        • Soliciting the performance of any illegal activity, even if the activity itself is not performed; and/or
        • Acting in any manner that might subject us to unfavorable regulatory action, subject us to any liability for any reason, or adversely affect our public image, reputation or goodwill, as determined by us in our sole and exclusive discretion.
      2. No High Risk UseYou may not use the Services in any situation where failure or fault of the Services could lead to death or serious bodily injury of any person, or to physical or environmental damage. For example, you may not use, or permit any other person to use, the Services in connection with aircraft or other modes of human mass transportation or nuclear or chemical facilities.
      3. Other
        • You may not register to use any Services under a false name, or use an invalid or unauthorized credit card in connection with any Services.
        • You may not re-sell or create a commercial product with the email accounts under your domain name.
        • It is also necessary for customers to not exceed any limits imposed on accounts by LK Domain.
    3. Prohibited Content and Activities
      1. Offensive ContentYou, the customer may not publish, transmit or store on or via the Services any content or links to any content that LK Domain reasonably believes:
        • Publish, transmit or store any content or links to any content that is excessively violent, incites violence, threatens violence, contains harassing content or hate speech, creates a risk to a person’s safety or health, or public safety or health, compromises national security or interferes with an investigation by law enforcement;
        • Is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
        • Is defamatory or violates a person’s privacy; or
        • Is otherwise malicious, fraudulent, and morally repugnant.
      2. Child PornographyChild pornography is prohibited. Any content that is potentially harmful to minors, as determined in LKDR’s sole discretion, is strictly forbidden, including but not limited to, child pornography or content perceived to be child pornography. Any website found to host child pornography or linking to child pornography will be suspended immediately without notice
      3. Other Prohibited Content
        We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our Terms of Service or this AUP in any manner may be removed from our servers (or otherwise disabled), with or without notice.
      4. Unacceptable Material
        Unacceptable material on our servers include without limitation:
  • Topsites
  • IRC Scripts/Bots
  • IRCD (irc servers)
  • Proxy Scripts/Anonymizers
  • Image Hosting Scripts (similar to Photobucket or Tinypic)
  • AutoSurf/PTC/PTS/PPC sites
  • IP Scanners
  • Bruteforce Programs/Scripts/Applications
  • Mail Bombers/Spam Scripts
  • Banner-Ad services (commercial banner ad rotation)
  • File Dump/Mirror Scripts (similar to rapidshare)
  • Commercial Audio Streaming (more than one or two streams)
  • Escrow/Bank Debentures
  • High-Yield Interest Programs (HYIP) or Related Sites
  • Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
  • Sale of any controlled substance without prior proof of appropriate permit(s)
  • Prime Banks Programs
  • Lottery/Gambling Sites
  • MUDs/RPGs/PBBGs
  • Hacker focused sites/archives/programs
  • Sites promoting illegal activities
  • Forums and/or websites that distribute or link to warez/pirated/illegal content
  • Bank Debentures/Bank Debenture Trading Programs
  • Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
  • Mailer Pro
  • Push button mail scripts
  • Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc)
  • Tell A Friend Scripts
  • Anonymous or Bulk SMS Gateways
  • Bitcoin Miners
  • PayDay Loan Sites (including any site related to PayDay loans, PayDay loan affiliate progams, etc)
  • Unacceptable Resource UsageYou may Not:
      • Use twenty-five percent (25%) or more of our system resources for longer than ninety (90) seconds at a time. Activities that could cause this excessive use, include but are not limited to: CGI scripts, FTP, PHP, HTTP, etc.
      • Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
      • Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
      • Run any software that interfaces with an IRC (Internet Relay Chat) network.
      • Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
      • Participate in any file-sharing/peer-to-peer activities
      • Run any gaming servers such as counter-strike, half-life, battlefield1942, etc.
      • Run cron entries with intervals of less than fifteen (15) minutes.
      • Run any MySQL queries longer than fifteen (15) seconds. MySQL tables should be indexed appropriately.
      • Include the local file rather than the URL when using PHP, include functions for including a local file. Instead of including “http://yourdomain.com/include.php“), use “include.php”.
      • Force html to handle server-side code (like php and shtml) to help reduce usage.
      • Use https protocol unless it is necessary; encrypting and decrypting communications is noticeably more CPU-intensive than unencryptedExcessive Use of Shared System Resources
  • Excessive Use of Shared System Resourcesyou, the customer may not use any shared system provided by LK Domain in a way that unnecessarily interferes with the normal operation of the shared system, or that consumes a disproportionate share of the resources of the system.
  • Infringement of Intellectual Property Rights, Proprietary Rights
    • You may not use our Services in a manner that infringes on or misappropriates the rights of another party in any work protected by copyright, trade or service mark, invention, or other intellectual property or proprietary information. This includes, but is not limited to, the unauthorized copying or distribution of movies, music, books, photographs, software, or any other copyrighted work.
    • You may not use the Services to download, publish, torrent, distribute, use, or otherwise copy in any manner any text, music, software, art, image, or other work protected by copyright law unless you have permission from the owner of the work to use or copy the work in that manner, or you are otherwise permitted by established intellectual property law to copy or use the work or rights in that manner;
    • You may not use the Services to publish content intended to assist others in defeating technical copyright protections; and
    • You may not display another person’s trademark without permission.
    • You may not use the Services to publish another person’s trade secrets, or to publish information in violation of a duty of confidentiality.
    • It is LK Domain’s policy to terminate the services of customers who are repeat infringers in appropriate circumstances.
  • Spam PolicyWe take a zero tolerance stance against the sending of unsolicited e-mail, bulk emailing, and spam. We may terminate the account of any User who sends out spam with or without notice.And also you may not:
            1. Use or contain invalid or forged headers
            2. Use or contain invalid or non-existent domain names
            3. Employ any technique to otherwise misrepresent, hide or obscure any information in identifying the point of origin or the transmission path
            4. Use other means of deceptive addressing
            5. Use a third party’s Internet domain name, or be relayed from or through a third party’s equipment, without permission of the third party
            6. Contain false or misleading information in the subject line or otherwise contain false or misleading content
            7. Fail to comply with additional technical standards described below
            8. Harvesting, mining or collection of e-mail addresses or other information from or through its network
            9. Otherwise violate AUP and other Terms of Service
  • AUP ViolationsYour Services may be terminated with or without notice upon any violation of this AUP. If applicable, violations will be reported to the appropriate law enforcement agency.A failure to respond to an email from LK Domain within forty-eight (48) hours, or as otherwise specified in the email, may result in the suspension or termination of your Services.No credit will be available under the LK Domain Service Level Agreement for interruptions of service resulting from any AUP violation.If you feel you have discovered a violation of our AUP please report to: mysite@domains.lk or mymail@domains.lk

END USER RESPONSIBILITIES – Mymail New Packages

  1. END USER RESPONSIBILITIES
    Effective use of the services provided by us presumes a certain degree of knowledge and skill on the part of the user. We will not be held responsible for their inability to use our services due to their lack of the requisite knowledge and skills.
  2. SERVER ABUSE
    Any attempt to undermine or cause harm to a server, or Client, of ours is strictly prohibited. This includes, but is not limited to, attempting to gain access to password files other than Client’s own, attempting to gain unauthorized access to other accounts on Client’s server, or anything that causes server malfunction. Failure to comply is subject to immediate account deactivation without refund.
  3. USAGE POLICY
    The Client will use the Email hosting services in a manner consistent with all local, provincial and federal regulations and laws. We reserve the right to suspend or cancel the Client’s access to any or all services provided by us when we decide that their account has been inappropriately used.
  4. Antispam and Antivirus
    1. E-mail Accounts purchased with the Service include an Antispam and Antivirus system. These systems are active both on e-mails received and sent for the identification of potentially dangerous ones containing attachments or other code whose execution could cause damage to the User’s systems or lead to the spread of undesired e-mails or information.
    2. The Client declares to be aware that the algorithms used can fail to identify dangerous and/or undesired e-mails, or that they can identify as dangerous and/or undesired e-mails that were instead desired. Therefore, the Client and their Users will be responsible for provided themselves with additional adequate tools for the protection against viruses and other cyber threats in addition to the Antispam and Antivirus system provided by the Service.
    3. The reference samples and algorithms used for the Antispam and Antivirus systems are defined and can be modified at the discretion of Provider in order to improve the service and increase its security. The same algorithm and the same samples are used for all the e-mail messages received and sent by the My Mail Server.
    4. Through the tools made available by the Service, the Client can specify a list of e- mail addresses belonging to the Whitelist and Blacklist. Messages received from e-mail addresses belonging to the latter will not be processed by the Antispam, but only by DNSBL, SMTP rules and Antivirus. Whitelist and Blacklist base their functioning on the correspondence of the headers present in the messages received and in particular by analysing the “Return-Path” and “To” headers.
  5. Quarantine
    1. The Quarantine archive contains e-mails identified as suspect by the Antispam system.
    2. Access to Quarantine can be made through Webmail or through E-mail client by connecting to the Spam folder via IMAP.
    3. Quarantined e-mails may be read, deleted or moved to other folders. Moving e-mails from Quarantine to other folders of the E-mail Account takes place under the direct and exclusive responsibility of the Client or User. This move cancels protection from viruses or potentially dangerous content and the e-mail in this case can be read via Webmail or collected via E-mail client.
    4. E-mails that are Quarantined for more than 30 calendar days are automatically and permanently deleted without notification or the possibility to retrieve them.
  6. Maximum e-mail account capacity
    1. When 100% of the maximum capacity of the E-mail Account Quota is nearly reached, the User will automatically receive a notice containing the notification of the imminent nearing of the maximum capacity. The Client or User must carry out the necessary interventions to free space or increase the E-mail Account Quota on request.
    2. All folders created by the Client or User via Webmail and/or their E-mail client in IMAP mode (including folders called Trash and Spam) contribute to reaching the E-mail Account Quota.
    3. Provider guarantees the Client, who carries out their own checks on whether or not the E-mail Account Quota has been reached, a monitoring system through the IMAP protocol and/or other tools made available by the Service. Provider is not responsible for the failure to send or receive messages due to reaching the maximum capacity of the Quota, and/or for messages that are larger than the maximum size allowed.
  7. Webmail
    1. The Webmail system makes the basic functions of an E-mail Client directly available via web, according to the “best effort” method.
    2. Provider reserves the right to modify the Webmail functions and denomination at any time, communicating it to the Client however with at least 30 days’ notice.
  8. E-mail addresses and aliases
    Each E-mail Account is associated with an e-mail address or one or more e-mail aliases in the form identificativo@nome-dominio.tld, according to the rules that are valid internationally for the definition of e-mail addresses and Service limits. The domain name can be chosen by the End-user from the domains they own, or of which they can demonstrate they manage.
  9. Service policy
    The conditions of use of the Mymail service (Service Policy) for the Service, are drawn up to protect Mymail, its Clients and Users and the general Internet community, from irresponsible or, in some cases, illegal activities.

    1. It is possible to send e-mails both by Webmail and by an authenticated SMTP server of the Service. Authentication by username and password is required to send e-mails. The number of e-mails that may be sent via Webmail or SMTP is limited and subjected to Antispam and Antivirus scanning, to prevent abuse of the service and maintain an adequate level of efficiency for all users;
    2. Provider reserves the right to modify the aforementioned parameters at any time, with notification to the Client at least 24 hours before the entry into force of the new limits of use without any provision of compensation for the Client.
    3. Sending e-mails via Webmail or authenticated SMTP server is only allowed if the sender’s domain (e-mail field “From”), is the same as the username used for authentication or another email alias or domain, belonging to the same Client and already active on Mymail.
    4. Should the Client and/or their Users make use of the Service that may preclude its proper functioning (possibly also for the other clients), and/or that causes complaints from third parties, Provider reserves the right to suspend or limit the use of the Service, without any provision of compensation for the Client.
    5. E-mail and Domain Aliases are not subject to cost or limits. However, use of the Mymail Service is not allowed predominantly or for the sole purposes of sending e-mail messages, unless there is an agreement signed between Provider and the Client. In the event of abuse, Provider reserves the right to suspend the Service.
    6. Any other use of the service, deemed incorrect or unlawful by Mymail, will result in the immediate blocking of the Client’s account and the Service, even without prior notice. Provider reserves the right to change the Service Policy at any time, by giving a notification via Email in the appropriate section dedicated to the topic without any provision of compensation for the Client.
  10. E-mail account migration
    1. Through the Provider Support Portal, the Service makes the possibility available for the Client to migrate the E-mail Accounts at the moment of creating a new Domain, and to migrate the-mail messages present on another mail server with the E-mail Accounts present and will depend on the situation – Additional charges may apply.
    2. E-mail Account migration is carried out by starting from a CSV or Excel file defined by Provider and prepared by the client or user; it will be the Client’s responsibility to verify the outcome at the end of the migration and possibly manually correct any omissions.
    3. Migration may only be used if the E-mail Accounts that are still active on the other mail server, are accessible through a protocol compatible with the Service. Once the migration process is completed, the Client must verify the outcome and transfer manually, or independently save the email messages that have not been migrated automatically through backup. Provider does not guarantee the outcome of the migration as its result may vary, based on the settings and limitations of the other mail server from which the emails are collected.
  11. Duties and responsibilities of Clients
    1. Clients that use the Provider Service are required to maintain conduct based on correctness, diligence and loyalty.
    2. Clients are solely responsible for all activities implemented through the Mymail Service.
    3. Specifically, Clients and Users undertake when using the Services, to comply with:

      this Contract;

      the rules of conduct that makeup Netiquette;

      the international Anti spam rules

      the applicable national and international laws;

    4. Clients are informed and have accepted that images, videos, messages, texts, photographs, sounds and more generally, any material or content transmitted to third parties through the Service falls under the sole responsibility of the Client, and more generally of the User from whom these contents originate.
    5. The Client is aware of being solely responsible for the transmission and/or sending and/or dissemination and/or publication with which the contents are made accessible through the Service (such as, for example: texts, files, opinions, photographic, audio and video material, information etc.) to third parties, as well as conduct and interactions with other users and therefore, Provider does not provide any expressed or implied guarantee regarding the legality, accuracy and reliability of the information and content transmitted by Users.
    6. It is understood that Provider cannot exercise any preventive control over the contents described above that are transmitted, disseminated and/or published through the Service, nor on the conduct implemented by the Clients.
    7. At its unquestionable discretion and without notice, Provider reserves the right to intervene on actions that breach the provisions of the Contract or which are offensive, illegal, harmful to the rights of others and/or which represent damage or violation of anyone’s privacy or security. In the latter cases, the Client also acknowledges that Provider may send a specific report to the competent Authorities, providing, on the request of the latter, the information in its possession that allows the identification of the Use, in order to allow the aforementioned Authorities to identify , prevent and repress illegal activities.
  12. Conduct and activities prohibited to Clients and Users
    1. In the event of Clients or Users violating one or more of the prohibited activities, Provider may temporarily suspend or permanently terminate the offender’s account and7or temporarily or permanently interrupt the provision of the Service.
    2. Transmission, distribution or maintenance of any type of material that violates any applicable law or regulation. This includes, without limitation, copyrighted material, registered trademarks, trade secrets or other intellectual property used without legitimate authorisation, pornographic material, defamatory or which constitutes illegal treatment or violates export control laws.
    3. Unsolicited e-mails (hereinafter referred to as Spam) sent in bulk. Forwarding any form of Spam through the Mymail network is prohibited. Likewise, sending Spam through networks of other service providers by advertising sites or using e-mail addresses or any other resources offered by the Mymail network is prohibited. The accounts or services provided by Mymail cannot be used to collect replies to messages sent by other suppliers if these messages violate this Policy or that of the other supplier.
    4. Managing mailing lists with unconfirmed registration. Registering e-mail addresses to any mailing list without the express and verifiable consent of the owner of the e-mail address is prohibited. All mailing lists managed by Mymail clients must have the registration confirmation mechanism (“Double Opt-in” or “Confirmed Opt-in”). The subscription confirmation message received by the owner of each e-mail address must be kept in a file for the entire existence of the mailing list. Purchasing e-mail address lists from third parties to send e-mails from any domain hosted by Mymail, or attributable to any Mymail account, is prohibited.
    5. Advertising, transmitting or otherwise making available any type of software, program, product or service that violates this Policy or the Policy of other suppliers, including (but not limited to) instructions for transmitting spam, flooding, mail-bombing or attacks of denial of service.
    6. Managing an account on behalf of, or in collaboration with, or by reselling the service for people or companies included in the Spamhaus Register of Known Spam Operations (ROKSO) on https://www.spamhaus.org.
    7. Unauthorised attempts by a user to access any account or computer that does not belong to them.
    8. Obtaining or trying to obtain services using ways to avoid the payment due.
    9. Accessing, altering, destroying or attempting to access, alter or destroy the information of Mymail clients or any user through any means or device.
    10. Deliberately participating in activities that create problems or denial-of-service to other users, whether they are resident on the Mymail network or on networks of other operators.
    11. Using the Mymail services, interfering with the use of the Mymail network by other clients or authorised users.
    12. Transmitting, distributing, publishing, soliciting initiatives related to gambling or to events with prizes that require authorisation from AAMS.
    13. Selling or transferring your Client profile to others for any reason.
    14. Using traditional E-mail Accounts as a data or message archive also for data processing purposes. The E-mail Accounts provided by the Mymail Service must be used by Users for the sole purpose of exchanging and consulting the e-mails sent and received. The user to whom the e-mail box is assigned must consult it periodically, at least every 30 days. Using the space of each E-mail Account for data storage is prohibited. All E-mail Accounts that only receive e-mail messages and are not consulted periodically are considered as “Archive”. In this case, Mymail will ask the Client to purchase the E-mail archive service and transfer the data and messages present in the standard E-mail Account to the Email Archive.
    15. Provider reserves the right to modify the prohibited activities at any time, by sending a notification to the Client in the appropriate section dedicated to the topic.
  13. LAWFUL PURPOSE
    Client agrees that any material submitted for publication will not contain anything leading to an abusive or unethical use of the Web Hosting Service, the Host Server, the Service Provider, independent subcontractors, or third-party subcontractors. Abusive and unethical materials and uses include, but are not limited to, pornography, obscenity, nudity, violations of privacy, computer viruses, harassment, any illegal activity, spamming, advocacy of an illegal activity, and any infringement of privacy. Client hereby agrees to indemnify and hold harmless the Service Provider from any claim resulting from the Client’s publication of material or use of those materials. It is also understood that the Service Provider will not publish information over the Internet which may be used by another party to harm another. The Service Provider will also not develop a pornography or warez web site for the Client. The Service Provider reserves the right to determine what is and is not pornography
  14. COPYRIGHTS AND TRADEMARKS
    The Client represents to the Service Provider and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to the Service Provider for inclusion in the Client’s web site are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend the Service Provider and its subcontractors from any claim or suit arising from the use of such elements furnished by the Client.
  15. INDEMNIFICATION
    Client agrees that it shall defend, indemnify, save and hold the Service Provider harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees associated with the Service Provider’s development of the Client’s web site. This includes liabilities asserted against the Service Provider, its subcontractors, its agents, its clients, servants, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by the Client, its agents, employees or assigns. Client also agrees to defend, indemnify and hold harmless the Service Provider against liabilities arising out of any injury to person or property caused by any products or services sold or otherwise distributed over the Client’s web site. This includes infringing upon the proprietary rights of a third party, copyright infringement, and delivering any defective product or misinformation which is detrimental to another person, organization, or business.
  16. ASSIGNMENT
    Neither this Agreement nor any rights or obligations hereunder, may be assigned by either Party without the prior written approval of the non-assigning Party, which approval shall not be unreasonably withheld.
